Terms of Service
- Prices are subject to change according to complexity, size, and medium of each individual piece.
- Clear instructions and visual references and/or of the commission request must be provided by the client. After review of the request a preliminary quote will be provided by the artist.
- Submitting a commission request does not guarantee a commission slot.
- High quality reference images are to be provided by the client. All images must be Safe For Work (SFW) and contain no sexual or inappropriate content (see clause 13). Any breach of this in any image will result in the rejection of the commission, no exceptions. If additional reference images are sent after the commission has been started and a payment has been made, and the new reference images breach this clause, there will be no refund issued and the commission will be terminated.
- The artist will not discuss commission work with the client via public forum, instant messengers, and private notes. All communication about the commission between the artist and client will be made through, [email protected] and Ko-Fi, to ensure all information is consolidated to one secure location.
- The commission must be paid up front in full before work begins. The artist will only accept payment through Ko-Fi.
- Commissions under $400cad are considered small works and revising sketches are not factored into the price.
- The artist reserves the right to reject critique and redlining pertaining to artistic skill and/or style preference if said critique reduces the artistic quality of the piece.
- If the client wishes to cancel their commission before work has begun they will be refunded 50% of what they paid.
- If the client wishes to cancel their commission during or after the inking and/or colouring stage they will not be issued a refund.
- The artist reserves the right to issue a refund and cancel a commission due to poor communication, rude or inappropriate behaviour, and/or inability to communicate in effective English.
- The artist ensures that the client will receive email updates on a commission when necessary. Clients are encouraged to check in when they feel it is necessary for updates, assurance or reminders.
- The artist will not accept commissions for the depiction of illegal activities, explicit R-rated materials and hateful images. Non-explicit fetish, kink, artistic nudity, violence, and gore will be considered on a case-by-case basis. The artist reserves the right to reject any commission for any reason.
- The artist retains the right to display all commissioned work on any personal website, gallery, social media platform or journal. If the commission piece is a time-sensitive gift the artist may delay public showcasing at the request of the client.
- The artist retains ALL rights to the commissioned artwork, including the right to make prints and merchandise for samples and portfolios. Licensing Rights to the artwork can be negotiated for an additional fee.
- The client may not make mass prints or merchandise of the artwork or profit from the artwork beyond the resale of an original physical signed artwork, drawing, or limited edition print (this does not include digital media).
- The client may resize or crop the artwork to create icons, wallpapers, or other graphics to be used in non-commercial digital format, but the client cannot alter the artwork itself. The client may also upload the artwork to their personal website, social media or gallery, but credit is required and only the watermarked WEB version may be used. Artwork can also be used as emoji on Twitch and Discord unless otherwise stated by the artist.
- Digital media commissions are permitted to print copies of the artwork, for personal use only. These prints may not be resold or put up for auction without the written consent of the artist. Any additional printing beyond the permitted agreement must be re-negotiated with the artist for an additional fee.
- The client may not post or share any works in progress (WIP's), thumbnails, concepts, sketches, rejected designs of their commission. The artist can share or repost works in progress (WIP's), thumbnails, concepts, sketches, rejected designs of the client's commission for portfolio purposes.
- Artwork (digital or traditional) will not under any circumstances be fed into Artificial Intelligence (AI) Websites and/or Ai App Program Art Generators in any stage of progress or completion and delivery of the commission project. Any violation of this clause will result in a cease and desist and/or legal action for breach of artistic copyright.
- The artist may recycle preparatory sketches that were rejected by the client for other commissions or personal works.
- The client must read, understand and agree to all the above terms before entering into an agreement with the artist. By sending payment, the client agrees to the above terms.
These Terms of Service are relevant to NON-COMMERCIAL projects only and are subject to revising, editing, and additions without notice. Prices and policies are based in part of the "Graphic Artists Guild Handbook: Pricing & Ethical Guidelines, 13th Edition" book.
